SHARING INFORMATION WITH THIRD PARTIES

IWH does not sell, rent, or lease personal information to third parties.

IWH may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to us, and they are required to maintain the confidentiality of your information.

IWH may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us or the Site; (b) protect and defend the rights or property of IWH; and/or (c) act under exigent circumstances to protect the personal safety of users of IWH, or the public.

We may share your personal information by disclosing it to a third party for a business purpose (“Business Purpose Disclosure”). We only make these Business Purpose Disclosures under written contracts that describe the specific purposes, require the recipient to keep your personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. In the preceding 12 months, we have disclosed personal information in a Business Purpose Disclosure to service providers to fulfill the purpose for that information, and with your consent as described further below.

Business Purpose Disclosures include the following circumstances:

  1. When we work with service providers. We may make Business Purpose Disclosures to service providers (including Getro and Slack), professional advisors, contractors, and other third parties that provide us with support services, such as payment processing (including Launchpass and Stripe), website hosting (the Site is hosted by Wix), information technology, sales, email and postal delivery, location mapping, product and service delivery, or analytics services, and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. This may include analytics and scheduling services provided by third parties such as Google Analytics and Luma.

  2. When we become involved in a sale or transfer of the company. We may make Business Purpose Disclosures if we become involved with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the company’s assets (whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding), to business entities or people involved in the negotiation or transfer.

  3. When we are required by law. We may make Business Purpose Disclosures to comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  4. To help protect lawful interests. We may make Business Purpose Disclosures if we believe disclosure will help us protect the rights, property, or safety of IWH, the Site, the Services, our users, partners, agents, and others. This includes exchanging information with other companies and organizations for fraud protection, and spam and malware prevention.

  5. To fulfill the purpose for that information or with your consent. We may make Business Purpose Disclosures to fulfill the purpose for which you provide the information, for any other purpose disclosed by us when you provide the information, or with your consent.

Other Users

When you share personal information (for example, by posting comments, contributions, or other content to the Site or Services) or otherwise interact with public areas of the Site or Services, such personal information may be viewed by all users and may be publicly made available outside the Site or Services in perpetuity. Similarly, other users will be able to communicate with you within our Services and view your profile. You should exercise caution when providing personal information in interactive areas of the Site and Services, including in direct messaging or when using any messaging or chat function.

USE OF AI TECHNOLOGIES

As part of our services, we offer certain products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, “AI Products”). These tools are designed to enhance your experience and provide you with innovative solutions. We provide the AI Products through third-party service providers (“AI Service Providers”), including Getro. As outlined in this Policy, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in “Sharing Information with Third Parties.” You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider. All personal information processed using our AI Products is handled in line with our Policy and our agreement with third parties. Nevertheless, you should exercise caution when interacting with AI Products and should not share sensitive personal information, such as your name, contact information, financial or insurance information.

LINKS

The Site and Services contains links to third party websites and services, community platforms, communication channels, job boards, talent networks, newsletters, and other integrated services that are made available via, operated by, or maintained by third parties, including Launchpass , Getro, and Slack. Please be aware that we are not responsible for the content or privacy practices of such other sites and services. We encourage you to be aware when you leave the Site and to read the privacy statements of any other site that collects personally identifiable information. Your interactions with or on any other sites or their respective services are solely between you and the relevant third party, and we do not control, endorse, or assume any responsibility for them.

HOW LONG WE KEEP YOUR INFORMATION.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. In addition, given the nature of sharing on the Services, some of the content and information related to your account, such as Contributions you make to chats, message boards, online forums, or direct messaging prior to deletion will remain accessible to the other users and stored on our servers.

SECURITY OF YOUR PERSONAL INFORMATION

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. The safety and security of your information also depends on you.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

YOUR RIGHTS AND CHOICES

Depending on your country, province, or state of residence, you may review, change, or terminate your account at any time.

Depending upon the state where you live, you may have the following rights:

  1. Right to obtain a list of the categories of third parties to which we have disclosed personal data (as permitted by applicable law)

  2. Right to limit use and disclosure of sensitive personal data (as permitted by applicable law)

  3. Right to correct inaccurate personal information that we maintain about you. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

  4. Right to limit the use or disclosure of your sensitive personal information for reasons other than those set forth herein.

  5. Right not to receive discriminatory treatment for exercising any of these rights.

The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights regarding their personal information.

  1. The Right to Know and Data Portability: You have the right to request that IWH disclose certain information to you about our collection and use of your personal information over the past 12 months.

  2. The Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. We will delete or deidentify personal information not subject to an exception under applicable law from our records and will direct our service providers to take similar action.

  3. The Right to Opt-Out of Sale: Although we do not sell personal information, you have the right to opt out of data-sharing practices. For the purposes of this Policy and the CCPA, a “sale” refers to the sharing or disclosure of personal information to a third party in exchange for valuable consideration.

To exercise your rights described above, please submit a request by emailing us at info@inwomenshealth.com. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.

We will not discriminate against you for exercising any of your CCPA rights.

CALIFORNIA “SHINE THE LIGHT” LAW

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes, and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section “Contact Information.”

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Policy.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

CHILDREN UNDER EIGHTEEN

By using the Site or Services, you represent that you are at least 18. IWH does not knowingly collect personally identifiable information from children under the age of 18.

EMAIL COMMUNICATIONS

From time to time, we may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from us or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email, you may opt out of such communications. Users who wish to unsubscribe from promotional or marketing emails can do so by clicking on the unsubscribe button located at the bottom of any email or by contacting us directly at info@inwomenshealth.com to request removal.

CHANGES TO THIS POLICY

IWH reserves the right to change this Policy from time to time. For example, when there are changes in our Services, changes in our data protection practices, or changes in the law. When changes to this Policy are significant, we will inform you. We may provide notice by sending an email to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information. Your continued use of the Site and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
